Navigating the Legal Landscape Following the SCOTUS Affirmative Action Ruling 

The Supreme Court's recent rulings on affirmative action (in Students for Fair Admissions, Inc. v. Harvard) and LGBTQ+ rights (in 303 Creative v. Elenis) have led to a proliferation of legal challenges against DEI programs implemented by associations, including scholarships, grants, contests, and fellowships. At the same time, associations face internal challenges to their efforts to build more diverse professional communities through inclusive policies. This session will summarize these recent legal developments and their implications for association DEI programs, and provide an overview of how legal precedents intersect with organizational DEI policies concerning membership and governance. Join us for this important exploration into the future legal landscape and how it affects your association.

Dorothy served on ASAE's International Associations Advisory Council and Technology Professionals Advisory Council. She received her law degree from the Dickinson School of Law of Pennsylvania State University in 2006, in addition to an LL.B. in 2003 from the National Taiwan University.  She is admitted in the District of Columbia and Virginia. Kevin Serafino is an attorney with experience advising nonprofit organizations – including public charities, private foundations, trade and professional associations, and social welfare organizations – on a broad range of legal issues. He leverages his decade of experience working in-house at two national trade associations to provide practical and actionable legal advice to mission-driven organizations.

Kevin counsels nonprofit organization clients on a wide array of matters, including formation, federal tax exemption, governance, affiliate relationships, operations, fundraising, and major transactions, among other issues. He also focuses on advising politically active organizations on federal and state lobbying, ethics, and campaign finance laws, and assists in designing compliance programs to complement high-profile and high-impact advocacy programs. In addition, he has extensive experience managing fundraising, strategy, and compliance for political action committees and other political organizations.
